License
Musician U: Telharmonium End User License Agreement, version 1.0, October 2026.
This End User License Agreement ("Agreement") is between you and Drake Descant ("Licensor"), the owner of Musician U: Telharmonium and publisher of the software under the Musician U brand, for the Musician U: Telharmonium software and its included documentation ("the Software"). By installing or using the Software, you agree to this Agreement.
1. License
Musician U grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on computers that you personally own or control. You may use the Software for personal, educational, and commercial music creation.
2. Your music and recordings
Musician U claims no ownership of music, recordings, performances, or other audio you create using the Software. You may use your output in personal and commercial projects without paying royalties to Musician U. You remain responsible for any third-party material that you add to your work.
3. Restrictions
You may not sell, rent, sublicense, redistribute, or make the Software or its installer available to others without written permission from Musician U. You may not present the Software or a modified copy as software that you created. You may not remove copyright, license, or attribution notices. You may not use the Software unlawfully. Nothing in this section restricts rights that cannot legally be restricted in your jurisdiction.
4. Ownership
The Software is licensed, not sold. Musician U and its applicable licensors retain their rights in the Software's original code, sound design, interface, artwork, arrangements, documentation, name, and branding. The historical Telharmonium design, Cahill's expired patents, and the public-domain compositions included remain free for anyone to use. Third-party technologies remain subject to their own license terms.
5. Privacy and local files
The Software does not require an account and does not send analytics, advertising data, or telemetry to Musician U. Settings and program state are stored locally on your computer. External links open only when you choose them and are governed by the destination's terms and privacy practices.
6. Historical reconstruction
The Software is a creative reconstruction of a historical instrument. Its pitches follow documented alternator data; its tone, receiver model, and arrangements are informed interpretations, since no recording of the original Telharmonium exists. It is not presented as a measurement of the original instrument's sound.
7. Hearing and system safety
Protect your hearing. Begin playback at a safe volume. Audio performance depends on the computer, operating system, audio device, driver, buffer configuration, sample rate, and other running software. Back up important projects.
8. Third-party software
The Software is built with the JUCE framework and the Steinberg VST 3 SDK, identified in the included Third-Party Notices. Those components are governed by their applicable licenses.
9. Updates and support
Musician U may provide updates, changes, or support but is not obligated to provide them. Future versions may have different features or terms. This release does not include a promise of continued availability or compatibility with future operating-system or hardware changes.
10. No warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSICIAN U WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, LOST RECORDINGS, BUSINESS INTERRUPTION, HEARING DAMAGE, OR EQUIPMENT DAMAGE ARISING FROM THE SOFTWARE OR ITS USE. WHERE LIABILITY CANNOT BE EXCLUDED, MUSICIAN U'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of Sections 10 and 11 may not apply to you.
12. Termination
This license ends if you materially violate this Agreement. If it ends, you must stop using the Software and remove your copies. Sections concerning ownership, disclaimers, and limitations survive termination.
13. Governing law
This Agreement is governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles. Any mandatory consumer protections that apply in your jurisdiction remain unaffected.
